What ar my options in NY?

My daughter had to move out of her house because she was being abused by her husband.  She then got an order of protection and filed for divorce.  That was in Feb.  Since Feb, her husband lost his job and is not paying towards the mortgage nor the other two loans that have the house as collateral.  We have a tenant in one half of the house, and my daughters husband is keeping the rent money which used to be used to help pay the mortgage.  Her lawyer says nothing can be done until the divorce is final, but by that time the 3 creditors will forclose on the house.  Meanwhile my daughter also has to pay rent on her apartment.  The husband also refuses to let the house be listed for sale by a realtor.

Having been a Realtor I can tell you that no one will list the house without his consent given they are both on the deed. It's illegal. Divorce is precisely why this is done the way it is.

As for the rent money I'm not clear who's name the deed is in or who's names are on the lease agreement. You'll have to give us more information on this.

Outside of paying the mortgage I don't see how you will keep the house out of forclosure. Your attorney is correct.

I sincerely hate to be the bearer of bad news and I wish you the best of luck.
