COULD SOMEBODY PLEASE HELP ME,MY HUSBAND AND I SEPARATED IN ABOUT MAY OF 2005 WE WERE MARRIED APRIL OF 1995. HE IS STATING WE SEPARATED ONE MONTH BEFORE OUR 10TH YR. DEADLINE FOR HIS SS BENEFITS AND PENSION ETC. HE SAYS WE WERE SEPARATED ON MARCH 7TH MY QUESTION IS, CAN ANYONE TELL ME IF THEY GO BY THE DATE YOU R SEPARATED OR BY THE ACTUAL DIVORCE DATE? WILL I STILL BE ABLE TO COLLECT HIS SS BENEFITS AND BE ENTITLED TO HIS PENSION?
is he in an apartment of his own? the only way I think you could prove he was there is by having your attorney, in your discovery, request he produce hos original signed lease copy, and that will show when he rented the apartment - which would be an indication as to when he left. If he doesn't have a lease - you don't have any way of proving when he left.
You need to hire an attorney - because PA is a fault grounds divorce state, and you are entitled to a lot more when you can prove adultery, and that very well could be a reason for the court to award you his pension. call around and see if any attoreny in your area will work out a payment plan with you - or you could go down to the superior court and apply for legal aid. as far as his offer - tell him to eat dirt.
You are still married, yes, but the fact you don't live together makes you separated. It doesn't have to be a court documented legal separation to be considered one.
