If you are legally seperated then this should be addressed in your seperation papers.... take a look through them very well and consult and attorney.

I think each state has their own rules about what legally seperated actually means and entails. I have a friend who is a realtor and she is also divorced. We were sharing stories, I'm just begining a divorce and hate the idea of not having my own home. I had ideas of buying as soon as I could. She stongly advised me to wait until the divorce is absolutely final. I never questioned her further so I can't say if she was just giving advice or if she had solid reasons to urge me to wait but I figure it can't hurt. I'd rather play it safe then let a greedy soon to be ex get his hands on something that should only be mine. Good luck with whatever you decide. I suppose you could always ask your attorney if you really want to buy.
