Obligated to pay mortgage but can't afford payments.

According to the divorce papers, I am obligated to make the mortgage payments for my ex while she lives in our home. My name is only on the mortgage but both of our names are on the title. Recently I have been laid off work and have not been able to make the mortgage payments and she has borrowed money from family members. Can she legally come back and request the court for the money that I was unable to pay and that she paid even though her name isn't on the mortgage? And, if the home goes into foreclosure, will that affect her credit if her name is only on the title?

I agree with the others, but I also think that you should contact the mortgage company asap.  Most mortgage companies will work with you to figure out a payment plan, lower your payments for a time, or grant you a forbearance for a few months until your situation changes or the court changes the order.

Does she work? You need to talk to your attorney and get something going fast. If you keep avoiding the payments and don't show that you have tried to change things it will be worse. You need to let the judge know your income has changed and she needs to help pay if she is going to live there.

I agree with Vicky...go back to the courts for a modification based on your unemployment status.

yikes. you need to either pay or go to the courts for modification of the orders. your name will be impacted creditwise....and you are obligated by court orders to pay this bill. if you can't you need to make changes to it quickly. i would let her know, so she can make sure she doesn't have the house go into foreclosure.
