Last name dilemma... 

I did not change my last name when i got married last sept. i wanted to wait until the new year and now as you may know, i found out he cheated in dec so when january rolled around i held off on changing it-not because it was an issue but it was the literally the last thing on my mind, now that the divorce papers are waiting to be served to him, i wonder with two children that have his last name do i want his last name too? i heard it could be an issue with traveling and would like for my children to go with me to the philipines to visit my mothers family(i heard its only a problem going overseas)someday. 

    My last name has never been a deep issue with me so i wouldnt mind having the same last name as my children( i see it as their last name not his, in some weird way, but thats how i feel).

    Is this weird? Help what would you do? or can i even do this now that i've filed for divorce if its okay with him?

I have no children, but I kept my married name. I just feel that this was a part of my life that I don't want to forget right now.  I made a mistake, and I want to be reminded for the time being. 

Some men find it weird, but they don't hassle me about it.

When I divorced the father of my children I decided to keep my married name(same one as kids father) so we, meaning my children and myself would easily always be identified as together,I did not wanjt the dilemma of explaing who I was in connection to my kids,schools,etc...also my kids knew me that way too,one less adjustment for them to make because of their innocence in the divorce.I tried to keep their stress to a minimal level.

Remarried and continued to keep same name as kids,thrilled I did,never would do it any other way! Good luck!

I had my name hyphenated after we married but when our eldest arrived I dropped the maiden name as having two difficult last names was too burdensome. After divorce I kept my ex's name as that's the name my whole identity is build upon (I am a foreigner and my whole history in US refers only to his name.) 
But most importantly, I wanted to keep the same name as my children; they had enough changes to deal with and having to get used to mom's new name was not an additional one I saw necessary for them to have to be burdened with. But that's just me. Like you, I regard this name more as a common denominator with my kids than anything else. In your case, you never changed your name hence I don't think I would be changing it now. I travel abroad extensively and never heard of any problems caused by different names. But I might be wrong. You will need his agreement to take the children out of the country though. And Passports, of course.

It doesn't have to be okay with him. That is yourl egal name and all you have to do is take the marriage license and change your name at SS and then your drivers license and bank accts.  It is your legal name.

If you're not sure check with your atty. It would be less confusing as far as school and the kids are concerned.

When I went to court we let the judge know I was keeping my married name and would not be changing it.
It was not a major issue for me. I had that name for over half my life and it was too much trouble for me to change it. I had no reason to change to my maiden name.
